These Terms and Conditions (“Agreement”) govern the use of Infrastructure-as-a-Service (IaaS) cloud services provided by TANB Virtual Infra Pvt Ltd.
By creating an account, accessing, or using TANB services, the customer agrees to be bound by these Terms.
1. Definitions
Company
“Company” refers to TANB Virtual Infra Pvt Ltd (“TANB”, “Company”, “we”, “our”, or “us”).
Customer / User
Any individual, company, or entity using TANB services.
Services
Cloud computing IaaS services including but not limited to:
- Virtual Machines
- Block Storage
- Networking
- Load Balancers
- Backup Services
Infrastructure
All hardware, software, networking equipment, and data centers operated by TANB.
2. Service Eligibility
To use TANB services, the customer must:
- Be legally capable of entering a contract
- Provide accurate registration information
- Complete KYC verification if required
- Comply with applicable laws and regulations
TANB reserves the right to reject or suspend accounts that fail verification.
3. Account Registration
Customers must provide:
- Full name or company name
- Valid email address
- Contact phone number
- Billing address
- Identity verification documents if requested
The customer is responsible for maintaining the confidentiality of:
- Account credentials
- SSH keys
Any activity performed using the account is considered authorized by the customer.
4. Description of Services
TANB provides Infrastructure-as-a-Service (IaaS) including:
Compute
Virtual machines with configurable CPU, RAM, and storage.
Storage
- Block storage volumes
- Snapshot storage
- Backup storage
Networking
- Virtual networks
- Load balancing
- Firewall services
Platform Management
Platform Management may include Web dashboard, APIs, automation tools, and monitoring services.
Services may evolve or change over time.
5. Acceptable Use Policy
Customers may not use TANB services for illegal or abusive activities.
Prohibited uses include but are not limited to:
Network Abuse
- Distributed Denial of Service (DDoS) attacks
- Port scanning without authorization
- Packet flooding
- Network disruption
Illegal Activities
- Fraud
- Phishing
- Identity theft
- Financial scams
Malware Distribution
- Botnets
- Viruses
- Ransomware
- Trojans
Spam
- Bulk unsolicited emails
- Email bombing
- SMS spam services
Content Restrictions
Hosting or distributing:
- Child exploitation material
- Illegal pornography
- Copyright infringement content
- Terrorism-related content
Cryptocurrency Mining
Cryptocurrency Mining is NOT Allowed.
Violation may result in immediate suspension without prior notice.
6. Payment and Billing
Customers agree to pay all applicable fees for services used.
Billing Models
TANB may offer:
- Prepaid
- Postpaid
Invoices
Invoices will be issued via email or dashboard.
Payment due dates must be respected.
Taxes
All applicable taxes including GST will be charged as per Indian law.
Late Payment
Failure to pay invoices may result in:
- Service suspension
- Late payment penalties
- Account termination
7. Resource Limits
Certain resources may be limited due to infrastructure capacity.
TANB reserves the right to enforce quotas.
8. Data Ownership
Customers retain full ownership of data stored in their virtual machines and storage volumes.
TANB does not claim ownership of customer data.
However, TANB may access data only when necessary for:
- Technical support
- Security investigations
- Legal obligations
9. Data Backup and Responsibility
Customers are responsible for:
- Backups of their data
- Disaster recovery strategies
- Securing applications and systems
TANB is not responsible for:
- Data loss due to customer misconfiguration
- Malware infection
- Accidental deletion
- Application errors
Snapshot or Backup services offered by TANB may require additional charges.
10. Service Level Agreement (SLA)
TANB aims to provide reliable cloud infrastructure.
Typical availability targets:
- Compute uptime: 99.5% or higher
- Network availability: 99.9%
Scheduled maintenance and force majeure events are excluded.
SLA credits may be provided according to the separate SLA policy.
11. Maintenance and Updates
TANB may perform maintenance activities including:
- Hardware replacement
- Security patching
- Network upgrades
- Software updates
Customers will be notified in advance when possible.
12. Security
TANB implements security controls such as:
- Firewall systems
- Network monitoring
- Intrusion detection
- Access controls
- Data center security
Customers are responsible for:
- Operating system security
- Application security
- User access management
13. Suspension of Services
TANB may suspend services if:
- Payment obligations are not met
- Acceptable Use Policy is violated
- Security threats are detected
- Government orders require suspension
Suspension may occur without prior notice if immediate action is necessary.
14. Termination
Either party may terminate the agreement.
Customer Termination
Customers may terminate services by closing their account and paying all dues to TANB.
Company Termination
TANB may terminate accounts for:
- Policy violations
- Fraudulent activity
- Non-payment
After termination, customer data may be deleted after a retention period.
15. Limitation of Liability
To the maximum extent permitted by law:
TANB shall not be liable for:
- Loss of profits
- Loss of data
- Business interruption
- Indirect or consequential damages
Total liability shall not exceed the fees equivalent to one month paid by the customer.
16. Indemnification
Customers agree to indemnify and hold harmless TANB Virtual Infra Pvt Ltd from claims arising from:
- Misuse of services
- Illegal activities
- Intellectual property violations
- Security incidents caused by customer actions
17. Intellectual Property
All infrastructure software, documentation, and systems remain the property of TANB.
Customers may not:
- Reverse engineer services
- Copy proprietary software
- Attempt to access restricted systems
18. Law Enforcement Requests
TANB may disclose customer information when required by:
- Court orders
- Government authorities
- Law enforcement agencies
19. Force Majeure
TANB is NOT responsible for service disruption caused by events beyond reasonable control including:
- Natural disasters
- Power failures
- War or civil unrest
- Government restrictions
- Internet backbone failures
20. Changes to Services or Terms
TANB reserves the right to modify:
- Service offerings
- Pricing
- Terms and conditions
Customers will be notified through the website or email.
Continued use of services indicates acceptance of the updated terms.
21. Governing Law
This Agreement shall be governed by the laws of India.
Any disputes shall fall under the jurisdiction of the courts located in:
Ahmedabad, Gujarat, India
